93 DECLARATION OF INTERESTS

Mr P K Beer declared a personal interest in Application No. B/07/00177 (Paper F214 – Item 10) by virtue of being a member of Suffolk County Council (and a member of the Environment, Waste Management Scrutiny Committee). He indicated that his interests were such that he was able to speak and vote on the matter concerned.

Mr J M Owen declared a personal interest in Application No. B/07/00177 (Paper F214 – Item 10) by virtue of being a member of Suffolk County Council, but indicated that his interests were such that he was able to speak and vote on the matter concerned.

Mrs E F Bates declared a personal and prejudicial interest in Application No. B/07/00342 (Paper F214 – Item 11) by virtue of being the wife of the applicant and withdrew from the meeting during consideration of the item.

95 PETITIONS

The Head of Corporate Services reported that in accordance with the Council Procedure Rule No. 13 a petition had been submitted to the Chief Executive as follows:-

Village Pond at Laurel Drive, Long Melford – Petition signed by approximately 156 residents requesting the reinstatement of the pond to its original area and the restoration of its wildlife population. The petition will be dealt with by the Head of Contract and Asset Management under delegated authority.

In accordance with Procedure Rules the Chief Executive had reported the receipt of the petition to the Council meeting held on 17 April 2007.

96 SITE INSPECTIONS

RESOLVED

(1) That a site inspection be held on Wednesday 25 April 2007 in respect of the under-mentioned site prior to consideration of the application by the Committee:-

SUDBURY

Application No. B/07/00168

Full Application – Erection of detached single storey dwelling (existing commercial building to be demolished). Alterations to existing vehicular access, part rear garden of 18 Constitution Hill.

Mr A E Pearce, Ward Member for Sudbury (East) had requested a site inspection to enable Members to assess the access arrangements and consider the impact on the residential amenity and overdevelopment.

Mr A E Pearce, Ward Member for Sudbury (East) had requested a site inspection to enable Members to assess the access arrangements and consider the impact on the residential amenity and overdevelopment.

RESOLVED

(1) That consideration of the recommendations of the Chief Planning Control Officer contained in (a) above be deferred.

(2) That a site inspection be held on Wednesday 25 April 2007, that the Panel of Members appointed under Minute No. 96 above inspect the site, and that a report thereon be submitted to the next meeting of the Committee, if appropriate.

Paper F214 – Item 1

Full Application – Erection of 2 no. two-storey dwellings and garages. Construction of new vehicular access, land adjoining Ivydene, The Tye.

Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission, a motion of approval was moved as Members felt that this would be sustainable development in accordance with PPS3 and did not feel an infill plot would prejudice other applications.

RESOLVED

That planning permission be granted subject to conditions as considered appropriate by the Chief Planning Control Officer.

(c) HADLEIGH

Paper F214 – Item 3

Full Application and Application for Listed Building Consent – Erection of 1m high (to top of rail head) iron railings, 94-96 and 96a (Plots 1-5 former Holbrows Showroom), Angel Street.

Notwithstanding the recommendation of the Chief Planning Control Officer to refuse permission, a motion of approval was moved as Members felt the proposals were a suitable form of enclosure.

Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission, a motion of approval was moved because Members felt that the application was protecting an existing employment site which would contribute to the economic viability of the village, and would not damage the vitality or viability of any town or village centre.

Members noted that contrary to the reference in paragraph 2 of the report, the means of access had not been submitted for consideration.

(h) HADLEIGH

Paper F214 – Item 9

Full Application – Erection of 8 two-storey dwellings with associated garages and construction of new vehicular access, land off Grays Close.

RESOLVED

(1) That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 regarding the provision of one rented unit and one unit of shared ownership affordable housing to be provided by the developer, and transferred to or managed by a registered social housing landlord in perpetuity

(2) That subject to the planning obligation referred to in resolution (1) above being secured, and to no new issues being raised as a result of the outstanding public consultation exercise, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:-

  • Materials;
  • As recommended by the County Highway Authority;
  • Levels; and
  • Landscaping.

(i) CHILTON

Paper F214 – Item 10

Application under Regulation 3 of the Town and Country Planning General Regulations 1992 – The extraction of sand and gravel from land at Chilton Estate, Chilton, Sudbury and restoration of the land to agriculture with woodland and hedgerow planting and new wildlife habitat, together with the erection and use of a concrete batching plant, aggregates bagging plant and construction and demolition waste recycling plant, OS0043, 7939, Part OS0079, 7612 land north and south of Winthrop Hall, Newton Road, Chilton.

Mr P K Beer requested that it be noted that the reason Great Cornard Parish Council had not responded to Babergh District Council’s consultation, was that he believed that they had not been consulted.

The Chairman of the Committee read out the contents of a letter dated 1 March 2007 from Great Cornard Parish Council which had been sent to Suffolk County Council. He also read out the views of Mr Peter Holbrook, the Ward Member for Bures St Mary.

Notwithstanding the recommendation of the Chief Planning Control Officer to inform Suffolk County Council that there were no objections to the principle of development, a motion of objection was moved as Members were concerned over the impact of the application on residential amenity, visual impact and highway safety.

RESOLVED

That Suffolk County Council be informed that Babergh District Council objects to the application in its current (amended) form for the following reasons:-

i) impact on landscape
ii) impact on residential amenity
iii) addition of traffic impact resulting from non-essential activities proposed on site

98 PLANNING PERFORMANCE

The Chief Planning Control Officer introduced a report (Paper F215) advising the Committee on the quarterly update figures detailing Babergh’s performance against the targets set by Central Government.

RESOLVED

That the report be noted.

Note: The meeting was adjourned between 11.10 am and 11.30 am for refreshments and 12.26 pm and 12.30 pm for a comfort break.

The business of the meeting was concluded at 3.00 pm.
