Paper F9 – Item 1

Full Application – erection of single storey front extension, 1 Landsdown Road.

Full Application – change of use from Class A1 (retail) to Class A5 (hot-food takeaway), 50 North Street.

Notwithstanding the recommendation of the Head of Planning (Control) to grant planning permission, a motion of refusal was moved because Members were concerned at the loss of a retail unit in the area, and the affect the proposal could have on residential amenity and traffic in the area. Upon being put to the vote, this motion was lost.

Members noted that the applicant for this proposal was Barratts and not Nestlé Purina as shown on the report.

A motion of refusal was moved because Members considered the proposal to be overdevelopment of the site and out of character with the surrounding development. On being put to the vote, this motion was lost. Members noted that Network Rail had confirmed the withdrawal of their objection to the proposed development, although they were currently negotiating with the applicant regarding safety improvements to the rail crossing. Members requested that Officers should reconsult with the Environment Agency to determine whether interceptors should be used to deal with any possible drainage problems.

It was noted that the Head of Technical Services had confirmed that the street scene elevation submitted was accurate except that the ridge height on the adjoining property (1 Greenview) had been shown 500mm too low. This would make the proposed building appear higher than it actually would be.

RESOLVED

That planning permission be refused for the following reasons:-

-contrary to Policies LP21 and HS19, whereby the proposed extension creates an annexe, which is not tied to the residential occupation of 27 High Street by a necessary Section 106 Obligation, and therefore the proposal is tantamount to the formation of a new dwelling in an unsuitable location
