78     ADDITIONAL ITEM OF BUSINESS

The Local Government (Access to Information) Act 1985 provides that an item of business may not be considered by a Committee unless it is included on an Agenda. The Act does however, make provision for an exception to a general rule to be made whereby reason of special circumstances the Chairman of the meeting is of the opinion that the item should be considered at the meeting as a matter of urgency. The Chairman advised that a situation had arisen where it had become necessary for the Committee to consider an item (approval of grant application under the Heritage Economic Regeneration Scheme (HERS)) and that he was satisfied that there were good reasons for dealing with this matter at the meeting as a matter or urgency.

79     DECLARATION OF INTERESTS

Mr P K Beer declared a personal interest in Application No. B/06/01842 (Paper F193 – Item 4) by virtue of being the Chairman of Great Cornard Parish Council who own the approach road to the site, but indicated that his interest was such that he was able to speak and vote on the matter concerned.

Mr P J Holbrook, Mr C J Hunt, Mr P Jones, Mr C D Kerr, Mr B L Lazenby, Mr N MacMaster and Mr J M Owen all declared a personal interest in Application Nos. B/06/01650 and B/06/02112 and B/06/02113 (Paper F193 – Items 5 and 9) and in Paper F197 by virtue of being Members of the Licensing and Appeals Committee, a sub-committee of which considered licensing applications. Their interest was such that they were able to speak and vote on the matters concerned.

RESOLVED

(1)     That site inspections be held on Wednesday 7 March 2007 in respect of the under-mentioned sites prior to consideration of the applications by the Committee:-

LONG MELFORD

Application No. B/07/00097/FUL

Change of use of annexe to form 1 no. dwelling, annexe, 27 St Catherines Road.

Mr R E Kemp, Ward Member for Long Melford, had requested a site inspection to enable Members to assess the possible impact of the application given the scale and nature of the existing structure and its use.


CHILTON

Application No. B/07/00177/CMA

Application under Regulation 3 of the Town and Country Planning General Regulations 1992. The extraction of sand and gravel from land at Chilton Estate, Chilton and restoration of the land to agriculture with woodland and hedgerow planting and new wildlife habitat, together with the erection and use of a concrete batching plant, aggregates bagging plan and construction and demolition waste cycling plant, land north and south of Winthropp Hall, Newton Road.

Mrs E F Bates, Ward Member for Waldingfield, had requested a site inspection to enable Members to assess the impact of the proposed entrance of the site onto the A134.

84    PLANNING APPLICATIONS FOR DETERMINATION BY THE COMMITTEE

Details of further objections and representations received in respect of Item Nos. 1, 2, 3, 4, 8, 10, 11 and 12 were reported to the meeting and were considered and taken into account before a decision was reached in each case. In accordance with the Council’s procedure for public speaking on Planning Applications, representations were made as detailed below:

RESOLVED

That subject to the imposition of conditions or reasons for refusal (whether additional or otherwise) in accordance with delegated powers under Council Minute No. 48 (a) dated 19 October 2004, decisions on the items referred to in Paper F193 be made as follows:

(a) BENTLEY

Paper F193 – Item 1

 

Full Application - erection of two storey detached dwelling and garage / workshop / garden store. Construction of new vehicular access, part side garden of Wayside, Capel Road.

Members noted that since the date of the report a revised access arrangement had been submitted and the comments of the County Highway Authority were awaited.

RESOLVED

That planning permission be refused for the following reasons:-

·     Inappropriate development outside the built up area boundary harmful to the open character of the countryside and its special landscape area setting thereby contrary to the objectives of PPS3 and PPS7, Suffolk Structure Plan 2001 Policies ENV6 and ENV8 and Babergh Local Plan Alteration No. 2 (2006) Policies HS02, HS04, HS28, HS30, CN01, CR01 and CR04.

·     As recommended by the County Highway Authority (if appropriate).

(b) KERSEY

Application No. B/07/00055

Paper F193 - Item 3 

District Planning Application – under Regulation 3 of the Town and Country General Regulations 1992 – construction of car park extension, land fronting 16 – 22 Vale Lane.

Members noted that the second phase of the proposal had now been deleted and the number of parking spaces provided would be 9.

RESOLVED

That subject to no objections being received from the outstanding consultees, the Chief Planning Control Officer be authorised to grant planning permission subject to the following condition:-

·     As recommended by the County Highway Authority.


(c) GREAT CORNARD

Application No. B/06/01842

Paper F193 – Item 4

 

Full Application – erection of 3 no. detached and 1 no. pair of semi-detached dwellings and garages. Alterations to existing vehicular access, land off Stevenson’s Approach, Broom Street.

Notwithstanding the recommendation of the Chief Planning Control Officer to grant planning permission, a motion of refusal was moved because Members were concerned that the proposed development would increase the flooding problem that was present in the area and would also add to traffic congestion at the access to Stevenson’s Approach.

RESOLVED

That planning permission be refused for the following reasons:-

·     Inadequate surface water drainage system

·     Increased traffic congestion at the Stevenson’s Approach access road.

(d) LONG MELFORD

Application No. B/06/01650

Paper F193 – Item 5

 

Full Application – change of use of part former sculpture garden to outside seating area and erection of extension to existing timber decking to provide additional seating area and erection of storage shed, Village Tea Rooms, Ringers Yard.

Mr C W Arthey, Ward Member for North Cosford requested a site inspection to enable Members to assess the impact of the application on the residential amenity.

(e) BILDESTON

Application Nos. B/06/02112 and B/06/02113

Paper F193 – Item 9

 

Full Application and Listed Building Consent – alterations and extensions to Crown Inn and 106 High Street to form dining room, three additional bedrooms and pot wash kitchen. Change of Use of 106 High Street to form additional accommodation for the Crown Inn, The Crown Inn, 104 and 106 High Street.

Mr D H Keane, Ward Member for Brett Vale, requested a site inspection to enable Members to assess the impact of the application on residential amenity and car parking and to assess the impact of the loss of a listed domestic property.

RESOLVED

(1)     That consideration of the recommendation of the Chief Planning Control Officer contained in (d) and (e) above be deferred.

(2)     That site inspections be held on Wednesday 7 March 2007, that the Panel of Members appointed under Minute No. 83 above inspect the sites, and that reports thereon be submitted to the next meeting of the Committee if appropriate.

(f) SUDBURY

Application No. b/05/00236

Paper F193 – Item 10

 

Full Application – alterations to ground levels to provide flood compensation scheme for housing development on adjacent land under Reserved Matters application B/01/02018/RES. Construction of cycle/footpath link to Quay Lane (as amplified by Agent’s letter dated 26/01/06), land adjacent to Priory Stadium, Priory Walk.

Members noted that although the application referred to in paragraph 7 of the report was submitted in 2001, it was not approved until 2005. Since the date of the report satisfactorily amended plans had been received relating to the public footpath on the northern side of the site.

RESOLVED

(1)     That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to ensure that the land is transferred to the Council for use as public open space with a commuted sum for its future adoption and maintenance.

(2)     That subject to the Planning Obligation referred to in Resolution (1) above being secured, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:-

·     Landscaping;

·     Protection of existing trees to be retained;

·     Protected species survey with appropriate translocation measures and the provisions of a refuge (elsewhere on site);

·     As required by County Highway Authority relating to fencing and safety measures;

·     Archaeology.

(g) WENHAM MAGNA

Paper F193 – Item 11

 

District Planning Application – construction of a parking bay (to facilitate 4 no. vehicles as amended by revised site plan and drawing No. TS/ENG-7217-4 Rev A, received on 5 February 2007), land adjacent 9 Church Close.


RESOLVED

That planning permission be granted subject to the following conditions:-

·     As recommended by County Highway Authority;

·     Landscaping.

(h) GREAT CORNARD

Paper F193 – Item 2

 

Full Application – erection of 2 no. two-storey dwellings with associated garaging. Construction of new vehicular access, part garden of 12 Cornerth Crescent.

Members noted that since the date of the report satisfactorily amended plans had been received relating to the site access and the County Highway Authority had no objections to them.

RESOLVED

(1)     That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to ensure the payment of contributions towards public open space provision.

(2)     That subject to the Planning Obligation referred to in Resolution (1) above being secured, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:-

·     Materials;

·     As recommended by County Highway Authority;

·     Landscaping.

(3)     That in the event of the Planning Obligation referred to in Resolution (1) above not being secured, the Chief Planning Control Officer be authorised to refuse planning permission for the following reason:

·     Inadequate provision of public open space and/or play equipment.

Full Application – conversion of single dwelling into 3 no. self contained flats, 44 Station Road.

RESOLVED

That planning permission be granted subject to the following condition:-

Full Application and Listed Building Consent – removal of 2 no. roof lights on north elevation roof slope; blocking up of 1 no. double door and insertion of two windows on north elevation, Stanstead Hall, The Hill.

RESOLVED

That planning permission and listed building consent be granted subject to the following conditions:-

·     Materials to be submitted;

·     Joinery details to be submitted and agreed.

Full Application and Listed Building Consent – erection of an underground tunnel link between the basement of the main dwellinghouse and the barns, Stanstead Hall, The Hill.

RESOLVED

That planning permission and listed building consent be granted subject to the following condition:-

·     As may be recommended by Suffolk County Council (Archaeology).

Full Application – change of use from amenity land to domestic garden, land adjacent to No. 10 Crowcroft Road.

RESOLVED

That planning permission be granted subject to the following conditions:-

·     Removal of permitted development rights for outbuildings;

·     Landscaping scheme.

85     APPROVAL OF GRANT APPLICATION UNDER THE HERITAGE ECONOMIC REGENERATION SCHEME (HERS)

The Head of Natural and Built Environment submitted a report (Paper F197) to secure authorisation from the Committee to enable the Head of Natural and Built Environment to approve a grant application under the HERS policy relating to a business premises, the tenancy of which is vested in a Member of this Council.

RESOLVED

That the application by Greene King Plc for a Heritage Economic Regeneration Grant be approved and duly authorised by the Head of Natural and Built Environment.

Note: The meeting was adjourned between 11.25 am and 11.45 am for refreshments.

The business of the meeting was concluded at 1.25 pm.
