REQUEST FOR MINOR AMENDMENTS TO APPLICATION REFERENCE B/06/01953/FUL - ERECTION OF 2 NO. DETACHED BUNGALOWS WITH DETACHED SINGLE GARAGES. ALTERATIONS TO EXISTING VEHICULAR ACCESS – 43 HIGH ROAD, LEAVENHEATH

The Chief Planning Control Officer to report that planning permission for the erection of 2 detached bungalows with detached garaging was granted to the rear of this site, behind the original dwelling at No.43 High Road (now demolished) on 3rd April 2007.  The applicants have submitted a request to amend the design of one of the approved dwellings and the following revisions are proposed to the bungalow under construction at Plot 3:-

  • The insertion of 2 No. velux rooflights in the rear elevation to provide additional daylight to the dining room.
  • The insertion of 2 No. side windows either side of a fireplace and chimney stack on the west elevation to serve the sitting room.

To omit the cropped hips from the roofs of the pairs of gables on the front and rear elevations.

 

 

Letters of objection have been received from the occupiers of nos. 5, 7 and 9 Edies Lane, which are located to the west and south, raising the following concerns:

  • The 2 No. side windows to the sitting room have been installed (disregarding planning laws), which are visible from within No.5 Edies Lane and will severely impact on privacy, particularly in bedroom areas, in breach of the Human Rights Act 1998.
  • The chimney has been constructed and is an eye sore to residents in Edies Lane and will cause pollution from smoke blowing into the rear gardens and affecting open windows.
  • If a smaller pitched roof is being replaced with a higher pitched roof then objections are made as a higher roof is a visible eye sore, blocking out sunlight.
  • Adjacent property will be overlooked following the insertion of the rooflights, resulting in a loss of privacy. Object to the change of building type from bungalow to chalet.
  • The existing building is already very intrusive to privacy and the proposed changes increase this intrusion.

 

 

 

The Officer’s view is that there would be no material impact upon residential amenity for the following reasons:-.

  • The rooflights are requested to provide additional daylight to the dining room on the ground floor and are positioned within the ceiling, thereby preventing the loss of privacy of neighbouring property from overlooking.
  • The 2 No. side windows that have been inserted in the western side elevation are positioned some 6 metres away from the rear boundary of No.5 Edies lane.  Each window is approximately 40 cm wide and are positioned either side of the fireplace and chimney stack that are also now proposed.  The grant of planning permission for this development includes a condition requiring the submission and approval of boundary enclosure details and to date these have not been submitted.  It is, however, expected that any boundary enclosure details that may subsequently be approved will include the provision of a 1.8m - 2m high close boarded fence adjacent to the rear boundary with No.5 Edies Lane.  The windows are at ground floor level and the provision of a 2m high fence will obscure any views to the rear of No.5 Edies lane and protect the privacy of its occupants.
  • The fireplace and chimney are viewed against the back drop of the built form of the bungalow and as such do not appear as an intrusive or over dominant feature.
  • The omission of the cropped hips from the gable pairs at the front and rear of the bungalow amounts to a change in the roof profile but not its height.  This is not considered to significantly alter the shape of the building or materially harm visual or residential amenity.

 

 

To conclude, the request for minor amendments is considered acceptable as it would not lead to a development which would reduce the amenities enjoyed by occupants of neighbouring property.  The changes would be compatible within the site’s setting and thereby is in accordance with development plan policies.

It is recommended that the minor amendments to the approved plans B/06/01953/FUL as detailed above be agreed.

BACKGROUND PAPERS

Notes:

(1)        A buffet lunch will be provided for Members in Committee Room 1.

(2)        Where it is not expedient for plans and drawings of the proposals under 
            consideration to be shown on the power point, these will be displayed in the 
            Council Chamber prior to the meeting.

(3)        Training for Members on ‘Accessing Planning Documents via the WEB’ will 
            take place in the Council Chamber after the conclusion of the meeting or 
            following lunch, whichever is the later.
