Mr A C Roberts, Ward Member for Berners, was present at the meeting and spoke on Item 3 of Paper J229 with the consent of the Chairman.

Mr R W Thake declared a personal interest in Application No. B/09/01469 (Paper J229 – Item 6) by virtue of being known to the owner of an adjacent property, and indicated that he would vacate the Chair and would not be present in the Chamber during consideration of this item.

Mr P K Beer, Ward Member for Great Cornard (South) requested a site inspection for Members to view the site and the surrounding area, the access road and the approach roads.
Members had before them an Addendum to Paper J229 (circulated to Members prior to the commencement of the meeting) summarising additional correspondence received since the publication of the Agenda, but before 12 noon on the working day before the meeting, together with errata.
In accordance with the Councils procedure for public speaking on planning applications, representations were made as detailed below:-

RESOLVED
That planning permission be refused for the following reasons:-
(i) The proposal for the erection of a 18.3 metre wind turbine is contrary to the Government planning policies and guidance set out in PPS5, to policies ENV6 and ENV7 of the East of England Plan, 2008 and to policies EN10, CN01 and CN06 of the Babergh Local Plan, Alteration No.2 (2006). These policies require development proposals to have a particular regard to the nature of development and the environment surrounding the site and preserve or enhance the character of a Listed Building or its setting. Local Plan policy EN10 sets out criteria against which proposals for renewable energy developments are considered and states planning permission will be grated for such development subject to their being no unacceptable impact upon the local environment, including (inter alia) visual intrusion and cultural heritage.
(ii) The proposed wind turbine, owing to the combined impact of its height, colour finish, position on the site frontage, appearance and bulk (including the size of the rotating blades atop the structure) would be an incongruous feature and unduly prominent in the landscape and would adversely affect the setting of the Grade II Listed Building, Brights Farmhouse to the detriment of its character.
The above decision was agreed on the Chairman’s casting vote.

Full Application – (A) erection of changing room extension. Retention of clear oak stain joinery of dwelling. Installation of satellite dish and aerial. Erection of external staircase to cartlodge. Removal of barn doors to front gable (mid-strey). Insertion of roof lights to rear elevation. Erection of boundary wall to north elevation, (B) - Change of use to domestic garden, erection of swimming pool, pump room and patio area wall (retention of), (C) -Erection of shed, greenhouse and dog kennel (retention of) and (D) Erection of fishing hut and construction of access track (retention of), Cures, Parsonage Green. |

Full Application – erection of one dwelling, rear of Hill House, High Street.

Notwithstanding the recommendations of the Chief Planning Control Officer to refuse planning permission, a motion to approve consent was moved as Members felt that the proposal would not have an adverse impact on the listed building. Upon being put to the vote this was approved.
RESOLVED
That planning permission be granted subject to conditions to be determined by the Chief Planning Control Officer in accordance with the Scheme of Delegation including:-
Landscaping condition relating to retention of existing trees.
Mr R W Thake returned to the Chamber and thereupon presided over the meeting.

RESOLVED
(1) That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to provide:-
· A planning obligation towards recreation provision under Policy HS32.
· The development to be undertake in accordance with the ecological mitigation strategy.
· A planning obligation towards healthcare infrastructure as requested by the PCT.
(2) That, subject to the completion of the Planning Obligation referred to in Resolution (1) above to the satisfaction of the Solicitor to the Council, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:-
· Standard time limit.
· Conditions relating to the submission of reserved matters.
· As recommended by BDC Environmental Protection.
· As recommended by the Environment Agency.
· As recommended by the Local Highway Authority.
· 10% of predicated energy to be supplied by low carbon, decentralise on renewable sources.
· The five houses to be delivered in accordance with Level 3 or above of the Code for Sustainable Homes.
(3) That in the event of the Planning Obligation referred to in Resolution (1) above not being secured within a reasonable time period (three months), the Chief Planning Control Officer be authorised to refuse planning permission for the following reason:
· The absence of a S106 Agreement relating to those items in Resolution (1).
Note: The meeting was adjourned between 10.55 a.m. and 11.15 a.m. for refreshments.
