Members had before them an Addendum to Paper K178 (circulated to Members prior to the commencement of the meeting) summarising additional correspondence received since the publication of the Agenda, but before 12 noon on the working day before the meeting together with errata.
Details of further representations received in respect of Item Nos. 1, 3, 4, 5, 7, 9 and 10 of Paper K178 were reported to the meeting and considered and taken into account before a decision was made in each case.

That subject to the imposition of conditions or reasons for refusal (whether additional or otherwise), in accordance with delegated powers under Council Minute No. 48(a) (dated 19 October 2004), decisions on the items referred to in Paper K178 be made as follows:-

(a) LONG MELFORD Application No. B/10/01078 Paper K178 – Item 2

Full Application – erection of four dwellings including three 2 bedroom houses and one 1 bedroom flat and alterations to Listed Building to create studio space shared between Houses 2 and 3, land west of Red House, Hall Street.
|
Members were asked to defer consideration of this application as an objection had been received from the Environmental Health Officer.
RESOLVED
That consideration of the application be deferred to enable the concerns of the Environmental Health Officer to be assessed.

(b) SUDBURY Application No. B/10/01516/ROC Paper K178 – Item 6 |
Change of use of land for car wash and valeting service, erection of storage container (continued use and retention of) the variation of Condition 4 attached to B/08/01390/FUL to allow permitted use to operate between 8.00 a.m. and 6.00 p.m. on Sundays, FS Hand Car Wash and Valeting, Homebase, Waldingfield Road.

Members were asked to defer consideration of this application as comments had been received from the Environmental Health Officer which required further discussion with the applicant.

Full Application – Proposed alterations, extension and change of use from A1 (Hardware Store) to A2 (Architectural Studio), Fountain House Stores, The Street. |

That planning permission be granted subject to conditions including:-

Full Application – Erection of first floor extension over existing garage as amended by agent’s letter dated 30/12/10 and revised plans 13B, 14C and 15B, 12 Chaplin Road.

The Chief Planning Control Officer’s recommendation that planning permission be refused for reasons relating to the effect of the proposal upon the appearance and character of the area was proposed and seconded but lost on being put to the vote.
A motion to grant planning permission was then moved on the grounds that the proposal would not result in a form of “terracing” in the street scene, would not be unduly prominent, and would not harm the character or appearance of the surrounding buildings or the locality. The development was therefore considered to be in accordance with policies CN01 and HS33.

That planning permission be granted subject to conditions to be imposed by the Chief Planning Control Officer under the delegated powers.

(e) EAST BERGHOLT Application No. B/10/01468 Paper K178 – Item 4 |
Full Application – Erection of two 1½ storey detached dwellings and cart lodge (demolition of existing dwelling), Ashmere, Hadleigh Road.

Notwithstanding the Chief Planning Control Officer’s recommendation to refuse planning permission for reasons relating to the form, scale and effect on the locality of the proposed development, a motion to grant planning permission was proposed and seconded. The motion was moved on the basis that the proposal represented an appropriate form of development, the cart lodge in front of the dwellings could be satisfactorily landscaped, the proposal did not constitute an overdevelopment of the site and was considered to be in keeping in terms of height, scale, mass and form and would not result in any harm to the locality. Members noted that a Section 106 Planning Obligation has now been completed in respect of small scale recreation contributions and considered that the proposal was in accordance with policies CN01, HS02, HS28 and HS32.
RESOLVED
That planning permission be granted subject to conditions to be imposed by the Chief Planning Control Officer under the delegated powers.

(f) EAST BERGHOLT Application No. B/10/01454 Paper K178 – Item 5 |
Full Application – Erection of two 1½ storey dwellings and one new vehicular access from The Drift (following demolition of existing bungalow) as amended by revised plan dated 17 January 2010 Home View, Slough Road.

RESOLVED
(1) That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act, 1990, to provide:
· A financial contribution towards public open space provision
(2) That, subject to the completion of the Planning Obligation in Resolution (1) above to the satisfaction of the Solicitor to the Council, the Chief Planning Control Officer be authorised to grant planning permission subject to conditions including:
· Samples of materials
· Removal of permitted development rights
· Details of levels
· Details of drainage
· Retention of parking and turning areas
· Details of boundary treatment
(3) That, in the event of the Planning Obligation referred to in Resolution (1) above not being secured, the Chief Planning Control Officer be authorised to refuse planning permission, for reasons including:
· Inadequate provision of public open space and play equipment contrary to Local Plan Policy HS32.

(g) CAPEL ST MARY Application No. B/10/01473 Paper K178 – Item 7 |
Full Application – Change of use from private school to dwelling and construction of new vehicular access, The Old Chapel, 65a The Street. |
Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission for reasons relating to loss of employment site and lack of private amenity space, a motion to grant planning permission was proposed and seconded. The motion was moved on the grounds that approval would not give rise to the loss of a community facility, the building/site was not viable in employment use, particularly given the previous use, and there was adequate amenity space. It was considered that the proposal was also acceptable in parking and highway terms. Members noted that a Section 106 Planning Obligation has been completed in respect of small scale recreation contributions in respect of Policy HS32. The proposal therefore satisfactorily addresses policies EM24, CR20 and HS32.

That planning permission be granted subject to conditions to be imposed by the Chief Planning Control Officer under the delegated powers.

Full Application – Replacement of existing 14.6m lightweight monopole mast with 14.4m medium duty monopole mast (apparatus height over 15 metres) installation of 6 antennas and construction of additional equipment cabinet, High Bank Cottage, Melford Road. |

Application under Regulation 3 of the Town and Country Planning General Regulations 1992 – Erection of replacement 1.8 metre high chainlink fence, timber fencing and double gates with 2.4 metre high tripoint palisade fence, timber fencing and double gates. Erection of 1 double gate and 1 single gate, Chilton Depot, Alexandra Road, Chilton Industrial Estate. |

The Chief Planning Control Officer submitted a report (Paper K179) providing Members with an overview of the number of applications and appeals currently being considered by the Planning Control Section and an indication of performance against national indicators for the period 1 October to 31 December 2010. The Officers responded to a number of questions from Members on the information set out in the report.
