The Chairman of the Sub-Committee referred to the procedure to be followed at the Hearing, a copy of which had been circulated with the Agenda.
The Head of Natural and Built Environment submitted a report (Paper J13) requesting the Sub-Committee to determine an application under the 2003 Licensing Act in respect of Favorite Chicken, Sudbury.
The applicant then questioned the Head of Natural and Built Environment.
Chief Inspector Ransome presented his report (contained in Appendix 3 of Paper J13).
Members and the Applicant then questioned Chief Inspector Ransome.
Mr J Halls presented his report (contained in Appendix 3 of Paper J13).
The Applicant and the Solicitor to the Council then questioned Mr Halls.
The Applicant then made an opening address and included a reference to a Petition, signed by 68 residents of the District in support of the application and referred to information from the Home Office on the impact of the Licensing Act on reducing crime and disorder. The other parties present at the hearing, having been given an opportunity to view this additional information did not object to this being part of the submission.
Members, Chief Inspector Ransome and Mr Halls then questioned the Applicant.
All parties were then requested to provide closing comments to the meeting. Following this all parties withdrew to enable the Sub-Committee to deliberate the application.
The meeting was then re-opened, to the public and the Council’s decision was notified.
The Chairman stated that, having taken into account all representations and submissions the granting of the application is likely to add to the level of crime and disorder to the detriment of the Town and its residents. The public nuisance grounds of objection is not supported as there is little or no evidence of noise/litter relating to the premises.
RESOLVED
That in addition to the Mandatory Conditions and the Conditions consistent with the Operating Schedule the hours and activities granted in respect of Favorite Chicken, Sudbury be as follows:-
