2 LICENSING ACT 2003 – HEARING REPORT – CORN CRAFT LIMITED MONKS ELEIGH

The Chairman of the Sub-Committee referred to the procedure to be followed at the Hearing, a copy of which had been circulated with the Agenda.

The Head of Natural and Built Environment submitted a report (Paper F136) requesting the Sub-Committee to determine an Application under the 2003 Licensing Act by Corn Craft Limited in respect of Bridge Farm, Monks Eleigh.

The Head of Natural and Built Environment also referred to letters of objection received from Dr T Walker of Meadow House and Mr J Ratcliffe of Paddock Hall that had been received within the statutory timescale and had been circulated prior to the meeting.

Members and Objectors then questioned the Head of Natural and Built Environment.

Mr Newman (Objector) presented his report to the meeting which supported his letter of objection which was contained in Appendix 2 to Paper F136. Following his presentation the Applicant questioned Mr Newman.

Mr Stott (Objector) presented his report to the meeting which supported his letter of objection which was contained in Appendix 2 to Paper F136.

Dr Walker (Objector) presented his report to the meeting which supported his letter of objection that had been circulated.


The Applicants made an opening address to the meeting in support of their Application. Following the presentation, the Applicants were questioned.

All parties were then requested to provide closing comments to the meeting. Following this all parties withdrew to enable the Committee to deliberate the Application.

The relevant parties were then invited back into the meeting and the Council’s decision was notified.

RESOLVED

That in addition to the Mandatory Conditions and the Conditions consistent with the Operation Schedule (as amended) the following Conditions be attached to promote prevention of public nuisance to the Application under the 2003 Licensing Act in respect of Bridge Farm, Monks Eleigh:-

(1) Timings:

(a)     Supply of alcohol (ON and OFF the premises):
         
Hours authorised:  10:00hrs until 22:00hrs (Monday to Saturday)
                                            
11:30hrs until 22:00hrs (Sunday)

(b)     Live music
          
Performances of dance
          
Provision of facilities for dancing:
          
Hours authorised: 10:00hrs until 22:00hrs (Saturday)
                                          
11:30hrs until 17:00hrs (Sunday)

(c)     Recorded music:
         Hours authorised:   10.00hrs until 17:00hrs (Monday to Friday)
                                            10.00hrs until 22.00hrs (Saturday)
                                            11.30hrs until 17:00hrs (Sunday)

(2)     Alcohol for consumption on the licensed premises shall be sold only to persons taking table meals in the premises and for consumption by such a person as an ancillary to his/her meal.

(3)     The licensed premises shall only sell beers, wines and ciders for consumption on the premises. Gift bottles of alcohol sold from the retail area of the licensed premises may include spirits providing such sales are for consumption off the premises.

(4)     Any recorded music or amplification equipment being used on the licensed premises shall be under the direct control of the designated premises supervisor, or another responsible individual nominated by the designated premises supervisor, with provision made for the volume level to be decreased upon the direct request of an authorised officer of the Local Authority or Police.

(5)     The premises licence holder shall ensure that windows and doors are kept closed (save for access or egress) during any performance of live music.


(6)     The premises licence holder shall ensure that appropriate signage is displayed prominently on the licensed premises requesting that patrons leave the premises quietly and with consideration to neighbouring properties.

The business of the meeting was concluded at 4.07 p.m.
