The Chairman of the Sub-Committee referred to the procedure to be followed at the Hearing, a copy of which had been circulated with the Agenda.
The Head of Natural and Built Environment submitted a report (Paper K1) requesting the Sub-Committee to consider an application to vary an existing premises licence at Liz’s Pizza and Kebab, 55 North Street, Sudbury.
The Solicitor to the Council then asked points of clarification to the Head of Natural and Built Environment.
Mr Koksal was then asked to make an opening address to the meeting in support of the application. It became evident at this stage that Mr Koksal had difficulty in understanding the English language and he was asked why he had not been represented. He indicated that his agent Whymark Moulton were not attending the meeting as he was not prepared to pay them for doing so.
During Mr Koksal’s presentation, following a request of clarification from the Solicitor to the Council, Mr Koksal agreed to amend Part L of his application (Appendix 2 of Paper K1) to indicate that the provision of late night refreshments will be indoor only.
Mr G Birchall, agent for an objector, Mr B Goat, then made an opening address in support of his objections which formed part of Appendix 3 to Paper K1. Members then questioned Mr Birchall.
All parties were then requested to provide closing comments to the meeting. Following this all parties withdrew to enable the Sub-Committee to deliberate the application.
The relevant parties were then invited back into the meeting to hear the Council’s decision. At this point in the meeting Mr Koksal’s brother, Mr A Koksal, who had a better understanding of the English language, was present.
The Council’s decision was notified.
The Chairman stated that the police report highlights a number of offences and incidents of anti-social behaviour in the town centre a high number of which is caused between 0200 and 0400hrs causing crime and disorder, public safety and public nuisance issues.
RESOLVED
That the Sub-Committee’s view is that any increase in opening hours will add to the level of crime and disorder to the detriment of the town and its citizens therefore the application under Section 34 of the Licensing Act 2003 to vary the premises licence at Liz’s Pizza and Kebab, 55 North Street, Sudbury be refused.
The business of the meeting was concluded at 10.15 a.m.
