The Chairman of the Sub-Committee referred to the procedure to be followed at the Hearing, a copy of which had been circulated with the Agenda.
The Head of Natural and Built Environment submitted a report (Paper J12) requesting the Sub-Committee to consider an Objection Notice given by the relevant Chief Officer of Police under Section 104 of the Licensing Act 2003 in respect of a Temporary Event Notice (TEN). Members were aware that the Chief Officer of Police can object where he is satisfied that allowing the premises to be used in accordance with the TEN would undermine the Crime and Disorder Licensing Objective. No other responsible authority or interested party can object to a TEN.
There being no questions on Paper J12, Inspector Crick presented the case for the Police Objection Notice and responded to questions from Members. He clarified that his letter of 17 April 2009 which formed part of Appendix 2 to Paper J12 related to the TEN and not the variation of hours application separately lodged with the Licensing Authority.
Mr Tekin made an opening address to the meeting in support of the application.
Inspector Crick then responded to some of the points made by Mr Tekin.
All parties were then requested to provide closing comments to the meeting. Following this all parties withdrew to enable the Sub-Committee to deliberate the application.
The relevant parties were then invited back into the meeting and the Council’s decision was notified.
The Chairman stated that although Sudbury is a small market town, it has a night-time economy greater and more vibrant than its size would usually warrant. This has led to a higher than average level of crime and disorder in the town particularly in the early hours of the morning. The police report highlights a number of offences in the immediate vicinity of the premises, the majority of which occurred between midnight and 03.15 a.m. Nearly half of all offences are recorded within the night time economy areas between 2000 and 0400hrs.
RESOLVED
That the Sub-Committee’s view is that any increase in opening hours will add to the level of crime and disorder to the detriment of the town and its citizens and therefore a counter-notice under Section 105 of the Licensing Act 2003 be issued to the premises user as the Sub-Committee is satisfied that this is necessary and proportionate in order to promote the crime prevention objective.
