RESOLVED
That pursuant to Part 1 of Schedule 12A of the Local Government Act 1972, the public be excluded from the meeting for the business specified below on the grounds that if the public were present during this item it is likely that there would be the disclosure to them of exempt information as indicated against the item.
The Committee was also satisfied that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The Chairman of the Committee referred to the procedure to be followed at the hearing, a copy of which had been circulated with the Agenda. A formal Police notification received by the Principal Licensing Officer was circulated and read by Members prior to the commencement of the hearing.
The Head of Natural and Built Environment submitted a report (Paper J211) concerning the application for the renewal of a combined Hackney Carriage/Private Hire Driver Licence from the person referred to in the report, and responded to questions from Members.
The Applicant then made an opening address during which he produced four letters in support of his application, which were read out to the Committee and subsequently copied and circulated to Members. The Applicant responded to questions, following which all parties were requested to provide closing comments prior to withdrawing from the meeting to enable the Committee to deliberate the application.
Members in reviewing the fit and proper status of the Applicant noted that the licence held by the Applicant expired on 10 March 2010. They were aware of the impending Crown Court trial, and considered that in the particular circumstances of the Applicant, a decision on the application should not be made until details of the Court ruling had been received, together with further relevant information.
The parties were then called back into the meeting and the decision of the Committee was notified.
RESOLVED
That the meeting be adjourned to another date, to be agreed, after the conclusion of the Crown Court trial of the person referred to in Paper J211. Further, that prior to consideration of the application at the reconvened meeting, the Applicant be required to supply the following information to the Principal Licensing Officer:-
- Details of the outcome of the trial
- Full medical report
The business of the meeting was concluded at 12.05 p.m.
