MINUTES OF A MEETING OF THE LICENSING AND APPEALS COMMITTEE HELD IN THE COUNCIL CHAMBER, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON THURSDAY 11 NOVEMBER 2010 (1.15 p.m.)

RESOLVED
That pursuant to Part 1 of Schedule 12A of the Local Government Act 1972, the public be excluded from the meeting for the business specified below on the grounds that if the public were present during this item it is likely that there would be the disclosure to them of exempt information as indicated against the item.
The Committee was satisfied that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The Chairman of the Committee introduced those present at the meeting and referred to the procedure to be followed at the hearing, a copy of which had been circulated with the Agenda.
Mr Carvell submitted the report of the Head of Natural and Built Environment (Paper K137) concerning the application for the grant of a new combined Hackney Carriage/Private Hire Driver Licence from the person referred to in the report, and responded to questions from Members.
The Applicant then addressed the Committee and responded to questions from Members and Mr Carvell in relation to a number of issues identified in Paper K137 and the Appendices. The parties were requested to provide closing comments prior to withdrawing from the meeting to enable the Committee to deliberate the application.
Members having taken into account the representations made at the meeting and in particular the explanations and responses given by the Applicant to the issues raised in Paper K137 concluded that they were not satisfied that the Applicant is a fit and proper person for the purposes of the licence applied for.
The parties were then called back into the meeting and the decision of the Committee was notified. The Applicant was also advised of his rights of appeal to the Magistrates Court and that refusal in this instance would not prohibit him from re-applying in the future and having such application determined on its merits.
RESOLVED
That as a result of its consideration in relation to the application for a new Combined Hackney Carriage and Private Hire Driver Licence from the person referred to in Paper K137, the Committee concluded that it was not satisfied that the Applicant is a fit and proper person to hold a Combined Hackney Carriage and Private Hire Driver’s Licence, and accordingly the application was refused pursuant to sections 51 and 59 of the Local Government (Miscellaneous Provisions) Act 1976.
The business of the meeting was concluded at 2 p.m.
