3          TREE PRESERVATION ORDER NO. BT417 – LAND EAST OF 1 NEW COTTAGES  THE STREET  BURSTALL 

Prior to the meeting of the Committee, Members met to view the English Oak covered by Tree Preservation Order No. BT417, to which the owner of the tree had submitted an objection. 

In addition to the Members of the Committee, the following were present for the site visit:- 

Mr D Pizzey (Arboricultural Officer)

Mr S Ellwood  (Democratic Services Manager)

Mr N J Fiske (owner/objector) 

Following the visit the Committee met to consider the objection to Tree Preservation Order No BT 417.  

Members had before them the following papers:- 

· Report by the Head of Natural and Built Environment (Paper K155), and Appendices - 

(a) Copy of Tree Preservation Order No. BT417.
(b) Copy of objection letter from Mr N J Fiske dated 16 September 2010.
(c) Photograph of the tree taken September 2010.
(d) Further letter from Mr N J Fiske dated 27 November 2010. 

· The Council’s ‘Procedure for Hearing and Determining Objections to Tree Preservation Orders’ (circulated with the Agenda). 

It was noted in Paragraph 6.1 of Paper K155, that the expiry date of the provisional existence of Tree Preservation Order BT 417 should be 13 February 2011. 

Members agreed with the views of the Head of Natural and Built Environment set out in Section 6 of Paper K155 and considered that the Tree Preservation Order should be confirmed.  They accepted the view in Paragraph 7.3 that the protection of the tree should prevail as the position of the tree in the locality has significant amenity value which benefits the whole community. 

RESOLVED  

That Tree Preservation Order No. BT417 be confirmed without modification.   

The business of the meeting was concluded at 10.45am.
