            MINUTES OF A MEETING OF THE LICENSING AND APPEALS COMMITTEE (TREES) HELD IN THE VILLAGE HALL, BOXFORD ON MONDAY 24 OCTOBER 2005 (11 A.M.)

               There were no declarations of interest.

 

11           QUESTIONS FROM MEMBERS

 

               None received.

 

12          TREE PRESERVATION ORDER No BT 396 – LAND AT GOODLANDS FARM, SWAN STREET, BOXFORD

           

Prior to the meeting of the Committee, Members met at the site to view the trees covered by Tree Preservation Order No. BT 396.

 

In addition to the Members of the Committee the following were present for the site visit:-

 

Ms K Barnes on behalf of Bates Wells & Braithwaite (Objector)

Mrs Johnson daughter of former landowner and joint executor of estate

Mr D Carmichael Arboricultural Officer

Mrs L M Sheppard Senior Admin Officer (Committees)

Mrs M Whiting Admin Officer (Committees)

 

Following the site inspection the Committee met to consider objections to the Order dated 2 August 2005.  Members had before them the following Papers circulated with the Agenda for the meeting:-

 

Paper E170, including a copy of Tree Preservation Order No BT 396 and a letter of objection from Bates Wells and Braithwaite dated 26 August 2005.

 

During the site inspection Members had enquired as to the status of the wall adjacent to T1.  Linda Sheppard, following consultation with Babergh’s Development Control Manager for the Western Area, reported that although the wall is not Listed there are certain constraints on it because it is in a Conservation Area.

 

In considering the objection to Tree Preservation Order BT 396 the Committee accepted the opinion of the Aboricultural Officer that tree T1 was a mature specimen which due to its age and position was not expected to grow significantly and was therefore unlikely to cause any damage to the nearby wall or barn in the future.

 

Members did not accept the Objector’s view that the inclusion of T2 would restrict the future use of the land, or that T3 was a poor specimen.

 

The Committee concluded that, although all three trees would benefit from professional tree surgery, they were not causing any damage to the structures on the site and were worthy of protection.

 

RESOLVED

 

That Tree Preservation Order No BT 396 be confirmed without modification.

 

 

The business of the meeting was concluded at 11.15 am
