RESOLVED

(1)    That the Minutes of the meetings held on 21 June, 13 and 16 July and 2 August 2007  be confirmed and signed as correct records. 

(2)    That the Minutes of the meetings of the Licensing Sub-Committee held on 7 June (10am and 11am) and 2 August 2007 be confirmed and signed as correct records.

19    DELEGATION TO THE HEAD OF COMMUNITY DEVELOPMENT TO DETERMINE APPEALS AGAINST DECISIONS ON HOMELESSNESS AND REVIEWS OF DECISIONS IN RELATION TO INTRODUCTORY AND DEMOTED TENANCIES 

Members had before them a report by the Head of Community Development (Paper G97) requesting delegated authority to determine various housing appeals and reviews.  It was noted that decisions to extend introductory tenancies could also be subject to review.  During the course of the discussion on the proposed delegations,  Members  took account of various matters including the appeal process available to those whose appeal to the Council was not allowed, and to tenants whose tenancies were terminated following review by the Council.  They were also aware of the experience gained from recent reviews carried out by Members.  It was generally accepted that the existing system for homelessness appeals being dealt with by officers should continue.  However, the majority view of the Committee was that, in relation to introductory and demoted tenancies, affected tenants should continue to have the opportunity of presenting their cases to Members for reviews of decisions. 

Members also raised the issue of keeping Ward Members informed of relevant matters in such cases, with a view to the amount and timing of information being appropriate to the role of Ward Members, and having regard to the normal constraints of confidentiality.            

RESOLVED 

(1)    That the Head of Community Development be delegated authority to determine appeals against decisions as to the housing status of homeless applicants. 

(2)    That reviews of decisions to terminate or extend Introductory Tenancies and to terminate Demoted Tenancies continue to be heard by the Licensing and Appeals Committee (Housing Matters). 

(3)    That Ward Members be informed at an early stage in cases where officers consider it appropriate to commence proceedings 

(a)    for possession

(b)    for the demotion of a tenancy
