Members had before them the report of the Head of Natural and Built Environment (Paper K51) asking the Committee to approve for consultation purposes the draft third edition of the Statement of Licensing Policy (Appendix 2 to the report). Members were aware that, following completion of the consultation process, a further report would be made to the Committee recommending a final draft Statement for adoption by the Council.
In presenting the report, the Principal Licensing Officer drew Members’ attention to the extent of the partnership working, led by Babergh, which had resulted in the revised draft document. Members were also advised that the Local Crime and Disorder Partnership (CDRP) referred to in paragraph 5.6 of the report had recently been re-named (now the Community Safety Partnership).
Mr Carvell responded to questions from Members on various related matters and concerns including the following:-
· Role of the Police in relation to enforcement of licensing conditions
· Relationship between costs and fees
· Co-operation between the various agencies including Suffolk County Council on licensing related matters
· The work being undertaken to establish costing levels and operational issues relevant to any integration or merger of services with Mid Suffolk District Council
As a result of its consideration, the Committee accepted recommendation 2.1 of Paper K51. Members also asked for various other actions to be taken.
RESOLVED
(1) That the draft ‘Statement of Licensing Policy’ in respect of Licensing Act 2003 functions, attached as Appendix 2 to Paper K51, be approved for consultation purposes.
(2) That the Head of Natural and Built Environment be asked to write to the Coalition Government in relation to the issue of licensing fees failing to meet the Council’s costs.
(3) That Licensing and Appeals Committee Members, together with those Babergh Councillors who are also Suffolk County Councillors, be advised of the procedures by which Suffolk County Council Highways consult with Babergh District Council for licensing, planning, street trading/cleansing, community safety matters etc. when the County Council is considering the grant of pavement café/seating permissions as part of a ‘Continental Café Culture.’
(4) That the Principal Licensing Officer in conjunction with the Director of Finance be asked to expand section 3 – Financial Implications – of the further report to be made to the Committee to address the concerns raised at the meeting about the costs of the licensing system, including start-up costs accrued during and since transition in 2005.
