On 13th August this year Babergh District Council’s Environmental Health team had been called in by neighbours of JCM Notley and CRC Verner, owners of Elm Tree Farm, Thorpe Morieux, who were anxious about the level of noise coming from the party at the farm.
Babergh’s officers responded quickly to residents’ concerns by visiting the location a number of times over the weekend in question. They agreed that the persistent volume of noise was unacceptable and slapped a noise nuisance notice on the organisers. This notice required that no further instances of excessive noise should be repeated. However, the provisions of the notice were breached on a number of occasions, prompting Babergh to prosecute the owners.
During the hearing, the magistrates explained that the penalties on both defendants of a £2500 fine and £375 costs reflected the serious inconvenience and disturbance suffered by the neighbours.
Mike Crisp, Babergh’s Environmental Health Manager was delighted with the scale of the fines, “ This prosecution sends a clear message to everyone creating anti-social noise levels. Babergh will not hesitate to come down hard on those whose selfishness and utter disregard for their neighbours means that they are content to create such a loud and prolonged disturbance”
