Babergh District Council has served an Interim Anti-Social Behaviour Order on local youth Karl Roberts.
An interim order, made at an initial court hearing held in advance of the full hearing, is a temporary order but can impose the same prohibitions and has the same penalties for breach as a full Anti Social Behaviour Order (ASBO).
Sudbury Magistrates' Court heard allegations from the Council that Mr Roberts had caused harassment, alarm and distress to persons in the district. In order to put an immediate stop to any anti social behaviour while the Council's application is processed in full by the Court, the Magistrates granted the Interim ASBO which will run until the full hearing at Bury St Edmunds Magistrates' Court next month.
The Court Order states that Mr Roberts is prohibited from:-
(i) behaving, in the District of Babergh or elsewhere in England or Wales, in a manner which causes or is likely to cause nuisance, harassment, alarm or distress to any persons not of the same household as himself;
(ii) inciting or encouraging, within the District of Babergh or elsewhere in England or Wales any other person or persons to behave in a manner which causes or is likely to cause nuisance, harassment, alarm or distress to any persons not of the same household as himself;
(iii) using threatening, abusive or insulting words in public towards any person in the District of Babergh or elsewhere in England and Wales;
(iv) engaging, in the District of Babergh or elsewhere in England or Wales, in conduct likely to place any person or persons in fear of their safety or the safety of their property;
(v) entering any part of Lindsey Court, Great Cornard, Suffolk and the surrounding area, such area being identified and marked in red on the map attached to this order;
(vi) approaching any witness or complainant in this case or any person employed at Lindsey Court or by Colchester Quaker Housing Association.
A spokesperson for Babergh District Council said “Breach of the Interim Order is a criminal offence. Anybody who learns that Mr Roberts has acted against the terms of the Order should report it to the Police immediately”.
The full hearing for the Anti-Social Behaviour Order will be heard at Bury St Edmunds Magistrates Court on 2nd March 2005. If successful, the full ASBO will last for a period of at least two years.
