Consent for the Siting of Seats

PUBLIC SEATS


Introduction

The Council has the authority to give consent for the siting of seats on Council or private land, under Section 14 of the Public Health Act 1925, where it is considered that the proposed siting is reasonable and subject to the County Council giving consent as the Highway Authority.

Procedure

  1. Applications are usually received from Parish/Town Councils and should include a plan indicating the exact position of the proposed seat.
  2. The applicant is advised that consent must also be sought from the County Highway Authority.
  3. If the land is privately owned, the applicant is advised that consent must also be sought from the landowner.
  4. The Council's Horticultural Services Manager is then consulted.
  5. If no objections are raised by the Council's Horticultural Services Manager, then a letter is sent to the applicant confirming that consent is given, under Section 14 of the Public Health Act 1925, subject to the following standard conditions;
    • Consent being received from the landowner (if appropriate).
    • Consent being received from the County Highway Authority. 
    • The seat to be positioned and installed to the satisfaction of the Council's Horticultural Services Manager. 
    • A suitable organisation (i.e. the Town/Parish Council) to be responsible for the future maintenance of the seat.
